Villas Formentera is a trading name of White Island Villas Ltd, company number 09104369, registered at 23 Victoria Avenue, Harrogate, HG1 5RD, North Yorkshire, United Kingdom.
Villas Formentera provides an independent villa marketing and booking introduction service specialising in holiday accommodation in Formentera and Ibiza.
We work with selected villa owners and local agencies and introduce guests to the owner or agency responsible for the relevant accommodation.
Villas Formentera is an independent intermediary and marketing service.

Once you decide to proceed with a booking, your accommodation contract is entered into directly between you and the relevant villa owner or local agency. Villas Formentera is not a party to this contract and has no ability to vary the contract or make any commitments on behalf of an owner or agency.
The owner or agency is responsible for the accommodation and for fulfilling the terms of the accommodation contract.
When you decide to proceed with a villa booking, Villas Formentera will provide the relevant information to the villa owner or local agency.
The owner or agency will then provide you with their rental agreement and payment instructions.
Your contract for the accommodation is directly with the villa owner or local agency, and not with Villas Formentera.
The rental agreement provided by the owner or agency will contain the specific terms applicable to your booking, which may include:

Where the terms of the owner or agency’s rental agreement differ from information previously provided by Villas Formentera, the rental agreement should be treated as the definitive agreement between you and the owner or agency.
All villa availability and prices are subject to confirmation by the relevant villa owner or local agency.
Information displayed on our website is provided to us by villa owners or local agencies and may change.
We aim to ensure that website information is accurate and up to date, but we cannot guarantee that availability, prices, facilities or other property information will remain unchanged, and we shall have no liability in respect of any information that is not accurate or up to date..
If you enquire about a villa, we will check the relevant information with the owner or agency where appropriate.
A villa is not considered booked simply because you have made an enquiry or received an indication of availability.
The booking becomes subject to the owner or agency’s confirmation and the terms of their rental agreement.
The price quoted by Villas Formentera will be the total price payable for the accommodation, including any mandatory charges that apply to the booking and can reasonably be calculated at the time the price is provided.
The price will include standard cleaning where this forms part of the accommodation price. Any optional services or extras requested by you after the accommodation price has been provided are not included in the accommodation price and will be charged separately.

Any such additional charges should be explained in the relevant rental agreement or booking information.
We take reasonable care to ensure that prices are displayed accurately. If an obvious pricing error is identified before the accommodation contract becomes binding, the correct price will be notified to you and you may decide whether to proceed. Neither Villas Formentera nor the owner or agency is required to accept a booking at a price which you knew, or reasonably should have known, was an obvious error.
The booking process normally works as follows:
Villas Formentera does not normally take payment for the accommodation or hold accommodation deposits.
Payment for the accommodation is made directly to the villa owner or local agency.
The owner or agency will provide you with the applicable payment instructions and payment schedule.
Villas Formentera does not determine the payment schedule, hold your accommodation payment or process refunds on behalf of the owner or agency.
Failure to make payment to the owner or agency within the timescales specified in the rental agreement may result in the booking being cancelled in accordance with that agreement.
Villas Formentera does not normally receive, hold or process payments for accommodation bookings. Payments are made directly by the guest to the relevant villa owner or local agency in accordance with the rental agreement and payment instructions provided by them.
Guests are responsible for taking reasonable care when making payments, including checking the recipient’s details before transferring funds.
Please be alert to fraudulent emails, payment requests or attempts to change bank details. If you receive a request to make or redirect a payment to different bank details, you should independently verify the request with the relevant villa owner or local agency using a trusted telephone number or other contact method before making payment.
Villas Formentera will not request that you transfer an accommodation payment to a different bank account from the one provided by the villa owner or local agency.
Because accommodation payments are made directly between the guest and the villa owner or local agency, Villas Formentera is not responsible for losses arising from fraudulent payment instructions, intercepted communications, bank fraud, phishing, impersonation or unauthorised bank transfers involving the guest and the owner or agency, except to the extent that such loss results from Villas Formentera’s own negligence, fraud, wilful misconduct or any liability which cannot legally be excluded or limited.
If you believe that you have received a suspicious payment request or that you may have transferred money as a result of fraud, you should contact your bank immediately and notify the villa owner or local agency. You should also notify Villas Formentera so that we can take appropriate action where possible.
Cancellation terms are determined by the villa owner or local agency and will be set out in the rental agreement provided to you.
If you need to cancel your booking, you should contact the villa owner or local agency directly using the contact details provided in your rental agreement.
Any refund will be dealt with by the villa owner or local agency in accordance with the terms of your accommodation contract.
Villas Formentera does not hold accommodation payments and therefore does not process refunds of accommodation payments.
If you wish to change your booking, including changing dates, the number of guests or other booking details, you should contact the villa owner or local agency.
Any change is subject to their agreement and availability.
The owner or agency may apply additional charges or other conditions for amendments, as specified in their rental agreement.
Villas Formentera may assist with communication where appropriate but does not have authority to approve changes on behalf of the owner or agency unless expressly authorised to do so.
Some villas require a security or damage deposit.
Where a deposit is required, the amount, payment arrangements and conditions for its return or deduction will be set out in the rental agreement provided by the villa owner or local agency.
The security or damage deposit is payable directly to the owner or agency unless their rental agreement states otherwise.
The owner or agency is responsible for holding, returning and, where applicable, making deductions from the deposit.
Any dispute concerning a security or damage deposit is between the guest and the villa owner or local agency.
Villas Formentera does not normally hold security or damage deposits.
Villa descriptions, photographs, facilities, availability and other property information are supplied by villa owners or local agencies.
We take reasonable care when selecting and presenting properties on our website, but we cannot independently verify every aspect of every property.
Property facilities, furnishings, surrounding areas and services may change from time to time.
If a particular facility or feature is important to your booking, please ask us or the owner/agency to confirm it before proceeding.
When staying at a villa, you agree to comply with the terms of the rental agreement provided by the villa owner or local agency.
You are responsible for:
You may be responsible for costs arising from damage or loss caused by you or members of your party, in accordance with the rental agreement.
Only the number of guests agreed with the villa owner or local agency may stay at the property.
Additional guests must not be accommodated without the prior agreement of the owner or agency.
Weddings, parties, events or other gatherings may only take place where expressly permitted by the villa owner or local agency.
Any specific restrictions will be included in the rental agreement or communicated by the owner or agency.
Arrival and departure arrangements vary between properties.
The villa owner or local agency will provide you with the relevant check-in and check-out instructions and contact details.
Some properties may have personal check-in, while others may use self-check-in or another arrangement.
The owner or agency is responsible for managing your arrival and departure arrangements.
If you experience a problem with the accommodation during your stay, you should contact the villa owner, house manager or local agency using the contact details provided to you.
They are responsible for dealing with maintenance, cleaning, access, facilities and other matters relating to the accommodation.
Villas Formentera may assist with communication where appropriate, but we do not manage the property or provide on-site accommodation services.
The Balearic Islands Sustainable Tourism Tax (Ecotax) may apply to your stay.
Where applicable, the amount, collection arrangements and whether it is included in the advertised price or payable separately will be confirmed by the villa owner or local agency.
The applicable tax may vary according to the accommodation and time of year.
We strongly recommend that you obtain appropriate travel insurance before travelling.
Your insurance should provide appropriate cover for circumstances such as cancellation, curtailment, medical expenses, travel disruption, personal belongings and other risks relevant to your holiday.
It is your responsibility to ensure that your insurance provides the level of cover you require.
Villas Formentera may provide information about recommended third-party services such as car hire, boat hire, private chefs, babysitting, housekeeping or other services.
Unless expressly stated otherwise, these services are provided directly by independent third-party providers.
Any contract for an additional service is between you and the relevant provider.
The provider is responsible for delivering the service and for its own terms, pricing, cancellations and refunds.
Villas Formentera will not be liable for delay or failure in providing its introduction services where that delay or failure is caused by an event outside its reasonable control.

The consequences of such events for your booking will be dealt with in accordance with the accommodation contract between you and the villa owner or local agency and any applicable law.
Some villas are located in rural or island areas where internet, mobile telephone coverage or utilities may be subject to interruptions.
Where internet access is provided, the owner or agency cannot guarantee uninterrupted availability or a particular connection speed.
Any issue with internet, electricity, water or other property services should be reported directly to the villa owner or local manager.
Villas Formentera acts as an independent intermediary and is not the provider of the accommodation.
The villa owner or local agency is responsible for the accommodation and for fulfilling the accommodation contract entered into with you.
To the extent permitted by law, Villas Formentera is not responsible for:

However, property information is based substantially on information provided by the relevant villa owner or local agency.
If you have specific requirements, accessibility needs, medical requirements, family requirements or other matters which are important to your stay, please raise these before entering into the accommodation contract so that they can be confirmed with the owner or agency.

When you proceed with a booking, we will provide the relevant personal information to the villa owner or local agency so that they can prepare the rental agreement, confirm the booking and communicate with you regarding the accommodation.
The owner or agency may request additional information directly from you where required for the booking or to comply with local legal requirements.
Villas Formentera does not normally collect or retain copies of passports.

The person making a booking must be at least 18 years old unless the relevant villa owner or local agency agrees otherwise in writing.
The person making the booking is responsible for ensuring that all information supplied on behalf of other members of the party is accurate.

However, we cannot guarantee that the website will always be free from errors, omissions or temporary inaccuracies.
Photographs and descriptions are intended to give a general representation of the property and its setting.

If you need our assistance in communicating with the owner or agency, you may contact Villas Formentera and we will make reasonable efforts to assist as an intermediary.
However, Villas Formentera does not replace the owner or agency as the party responsible for the accommodation contract.
We may update these Terms & Conditions from time to time to reflect changes to our services, website or legal requirements.
The version published on our website at the time of your enquiry will apply to the services provided by Villas Formentera, subject to any specific terms contained in the accommodation contract between you and the villa owner or local agency.
These Terms & Conditions relate to the services provided by Villas Formentera.
They do not replace or alter the terms of the accommodation contract between you and the villa owner or local agency.
Any dispute concerning the accommodation itself, including the condition of the property, payment, cancellation, refunds, security deposits or performance of the accommodation contract, should be dealt with under the terms of that accommodation contract and the law applicable to that contract.
Any dispute specifically concerning the services provided by Villas Formentera shall be subject to applicable UK law and the jurisdiction of the courts of England and Wales, except where mandatory law provides otherwise.
