Here you can find our booking terms and conditions. Please read these carefully before booking a villa.

Who we are

We are White Island Villas Ltd registered at 23 Victoria Avenue, Harrogate, HG1 5RD, North Yorkshire, United Kingdom, trading as Villas Formentera. Your booking is made on and subject to these terms and conditions.

Your contract

1. We are the appointed agent for the villa owner with whom your contract for the provision and use of the accommodation is made on behalf of yourself and all other persons named in the booking, and references to “you” and “your” include reference to all such persons. The contract incorporates these terms and conditions. Any further applicable terms and conditions of the particular villa owner will be notified to you when we confirm the availability of the accommodation.

2. Your contract with the villa owner will begin when we receive your deposit.

3. All bookings are subject to the availability of the accommodation which we will confirm with the villa owner before accepting a booking from you on their behalf.

4. You must be at least 18 years of age to make a booking with us. If you are under 18 years of age, we will require a written and signed guarantee from a guarantor over the age of 18.

Pricing errors and web site content

5. We will confirm the price of the accommodation when we confirm its availability. If the price as advertised on our web site is incorrect, neither we nor the villa owner will be under any obligation to accept a booking at the advertised rate. We reserve the right to correct any pricing errors on our website and the booking will be offered to you at the correct price.

6. Images and descriptions on the website are provided by the villa owners. We will not be held liable for any incorrect or inaccurate information, for any act or omission of the villa owner or for any other non-performance of the villa owner’s obligations to you.

Payment

7. We will require a deposit of up to 50% of the total price (unless specified different on your individual contract) which will be payable within 48 hours of our confirmation of availability, after which the property may be made available for an alternative booking.

8. The booking deposit is non-refundable except where your booking is cancelled by the villa owner when clause 21 below shall apply.

9. The remaining 50% of the price will be payable no later than 8 weeks before your scheduled arrival at the villa (unless specified different on your individual contract). Failure to pay on time may result in your booking being cancelled and the villa made available for alternative bookings. Your booking and deposit will be lost.

10. For bookings made within 8 weeks of your scheduled arrival at the villa, payment will be due in full. This must be paid within 48 hours of confirmation of availability after which the property may be made available for an alternative booking.

Your Responsibilities

11. You are responsible for any and all costs, expenses or other financial outlay incurred by the villa owner which arises directly or indirectly from any loss or damage to the villa and which results from your negligence and/or the negligence of any other person in the villa with your permission. Any existing damage found at the villa upon your arrival must be immediately notified to us, otherwise it will be deemed to have arisen during the period of your use of the villa.

12. Some villa owners may require a damage deposit. This will usually be payable in cash to the villa manager on check-in to the villa. Failure to pay this may result in your booking being cancelled and the denial of entry to the villa. In the event of such cancellation, the villa owner shall be entitled to retain all money already paid and shall be under no liability to you.

13. No events such as weddings or parties shall take place on the land of or inside the villa without prior consent of the villa owner. Failure to obtain consent will result in a surcharge or loss of full security deposit.

14. You are responsible for obtaining travel and any other relevant insurance to protect you and your belongings for the duration of your stay at the villa and/or your travel to and from the villa.

Liability

15. The villa owner shall not be liable for any loss or damage suffered by you unless such loss or damage arises as a direct and foreseeable result of negligence and/or a breach of these terms and conditions on the part of the villa owner.

16. The villa owner shall not be liable for any acts or omissions relating to the performance of the holiday contract which results from or is caused by an event outside their control. This includes but is not limited to war or threat of war, terrorist attacks or other activities, strikes, industrial actions by third parties, fire, storms, floors, subsidence and failure of public or private telecommunication networks. It is advised to have your own travel insurance policy to cover the above.

17. If an event outside our control or the control of the villa owner occurs which may have some effect upon the provision or use of the accommodation, we will use all reasonable efforts to contact you as soon as reasonably possible.

18. Your contract is with the villa owner and not with us. Consequently we shall not be liable for any loss or damage suffered by you or for any breach of contract by the villa owner. We act as agent only at all times and our liability shall remain limited accordingly.

Amendments and Cancellation Policy

19. You shall be entitled to make any reasonable amendment to the booking up to 8 weeks before arrival, subject to the consent and acceptance of the villa owner. An administration charge of €30 will be charged per amendment.

20. If you cancel your booking, the villa owner shall be entitled to retain the deposit and to charge a cancellation charge of €30. If you have already paid the balance of the price, such money will be refunded according to when the cancellation is made, subject at all times to the agency’s right to withhold and retain the cancellation charge. Refund Schedule:

21. In the event of the cancellation of your booking by the villa owner (except by reason of clause 12 above), you will be entitled to a full refund of all money which you have already paid for the accommodation, excluding any insurance premium and excluding any administration fees already paid for an amendment to the booking in accordance with clause 19 above, but no compensation shall otherwise be payable by either the villa owner or, for the avoidance of doubt, by us.

21.a. COVID – 19 cancellation policy

In the extreme event of border closures, government lockdowns or flight cancellations due to Covid-19, you will be offered the opportunity to postpone your trip to a future date *Subject to the dates being available, free of charge, and valid for 1 year from the date of original stay. If there is a difference in fare for the new dates i.e high season, different time of year etc, the difference in price will be added onto the booking and will need to be paid according to the individual terms & conditions of that particular villa.
A new rental contract with the new dates and price differences if any, will be produced free of charge.
For a selection of villas, it may be possible for a full refund of your original payment minus a cancellation fee.
We recommend obtaining a travel insurance that covers you for any travel cancellations/loss of accommodation fees or illness during pandemics including Covid-19.

Tourist tax

22. All visitors to Spain & the Spanish islands are required to pay a tourist tax upon arrival, being approximately € 2.20 per person per day during high season (May to November) and € 0.55 per person per day during low season. This only applies for persons of 16 years and older.
This is an separate charge and is not included in the total villa rental unless specified.

Governing Law and Jurisdiction

23. This agreement is governed by English law and the courts of England and Wales shall have exclusive jurisdiction in relation to any disputes arising from it.
